Court says Marine should go to trial in Iraq case (AP)

SAN DIEGO ? A military court has rejected an argument by defense lawyers to dismiss a major Iraq war crimes case involving a Marine whose squad killed 24 Iraqis in Haditha in 2005.

The court said in an opinion Thursday that it disagrees with the defense that the Marine Corps unfairly allowed the prosecution's team of military lawyers to remain on active duty, but denied the same request for the defense of Staff Sgt. Frank Wuterich.

The court said retired Marine Lt. Col. Colby Vokey's relationship with Wuterich as his lead military counsel wasn't interrupted substantially by his retirement in 2008 because he continued to represent him as a private lawyer until 2010.

Defense lawyers could not be reached for comment.
